Title of Goods

Title of goods does not pass to the purchaser until the goods are paid in full.



Quality and Use of Equipment

RCD Retail Ltd makes every effort to ensure that the products advertised on our site are of a high quality. We are governed by the manufacturer's ability to provide the quality of product however there are times when this may be beyond our control. We make every effort to ensure that the purpose for which the product is advertised is the correct one. Equipment must at all times be used in conjunction with the manufacturer's instructions, please read carefully before use. Unless otherwise stated all out items are sold solely for the purpose of home use. Items purchased and used in a commercial setting will not be covered by our warranty terms and conditions. If the item is used in a commercial setting and you require parts please contact us on 01273 384996 and we will provide a quote for the required parts.



Description of goods

The description of the goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the goods specified are as the buyer intended to order.

Product dimensions are provided my the manufacturer and are correct at the time of going to print - occasionally the manufacturer may introduce some design changes to products and dimensions may occasionally change slightly. This is out with our control and if you have any questions pertaining to dimensions then please contact our sales team.

It is the responsibility of the buyer to ensure the good will fit into their property. For example a 150x200cm bed is the dimensions of the sleeping surface and the external dimensions of the bed frame may be bigger - this should be checked on our site. A reasonable charge will be deducted from any refund if goods are returned because they cannot fit into the customer's property.

RCD Retail LTD reserves the right to cancel any order that is made subject to an error on its website and the customer will be refunded in full.



Delivery

Please see the delivery section of our website for all our delivery options and their terms.

Deliveries are to ground floor, front door; however the driver may take the item to a room of your choice at their discretion.

RCD Retail LTD accepts no responsibility for damage/ loss caused to your property if the driver enters your property.

RCD Retail LTD will endeavour to deliver the goods within the time stated on our website, however from time to time factors outside of our control mean that delivery is delayed. We will always try to notify you when this happens by email or phone.

RCD Retail LTD accepts no liability for consequential loss due to late delivery of goods.

If your item shows signs of damage on delivery it is crucial that you write "DAMAGED" on the delivery note. In signing for the item you are agreeing that the item has been delivered to the best of your knowledge in perfect condition and we may not be able to hold the courier responsible. In addition to this please ensure that all items are inspected and any damage is reported to us within 24 hours of receipt for your claim to be processed.

In most cases we may request for Photographs to be emailed to us to enable to your claim to be processed as quickly and conveniently as possible

In the event of failed delivery such that the item is returned to us, then the buyer will be responsible for the cost of the return carriage.



Warranty Conditions

Unless specified otherwise in the item description warranty is for 12 months parts and labour which covers you against manufacturing defects, excluding all moving parts (mechanisms, castors, drawers etc) and upholstery which are subject to usage related wear and tear. We must be informed of all warranty issues immediately upon their discovery in writing or via email. Please note that for customers living in Ireland, warranty is strictly parts only and the customer may be asked to contribute to any postage / courier costs incurred in resolving a problem. RCD Retail Ltd reserves the right not to apply the warranty in cases of inappropriate use or when the product has been tampered with by a third party non-authorised personnel. We also reserve the right to have the goods independently inspected before a decision is made as to how to proceed.



Cancellation and Refunds

Orders placed before 11:59pm Thursday 12th June 2014:

Items that are held in stock, usually defined by being available for next day or 7 day delivery, can be cancelled if you notify us in writing within 7 working days (from the day after receipt) and subsequently return your item to us we will issue a full refund of the purchase price. Delivery charges are none refundable where delivery is chargeable at the time of order to include specialist delivery, upgraded services and surcharges. For the cancellation to apply the buyer will be fully responsible for the cost of returning the item in all cases. The item returned should be in good/like new condition otherwise the refund may not be granted. Please make every effort to keep the original packaging as transporting unboxed products by courier can cause a lot of problems and may result in a loss to the consumer. It is also recommended that full insurance is taken out on your return for your own protection in case of loss/damage etc.

Items that are not held in stock and are made to order specifically for the customer cannot be cancelled once the order has been passed to the manufacturer (usually the same day as the order is placed with us). Due to the nature of made to order items approximate delivery timescales can be provided upon request of your order and in most cases this will be within 30 days but should not exceed 60 days unless otherwise agreed.

Due to reasons of health and hygiene mattresses (inc Vacuum packed), pillows, mattress protectors, duvets etc, will be deemed to be used when they have been unsealed/opened and cannot be returned for any reason other than a manufacturing fault and are therefore exempt from the statutory 7 day cooling off period under the Distance Selling Regulations. When the goods have been received back by our warehouse we will carry out a full inspection. We do understand that you may have to remove them from their packaging to inspect the goods as you would be able to in a shop (excluding those stated above for hygiene purposes). However, if they are deemed to have been "used" beyond that which is reasonable care and/or are soiled in any way we will deduct a reasonable amount from the refund to cover the costs of the goods or the customer will have the option of having the goods returned to them at their cost.

Items that are held in stock, usually defined by being available for next day or 7 day delivery, can be cancelled if you notify us as per the 14 Day Right to Cancel policy below

14 Day Right to Cancel

You have the right to cancel your contract within 14 days without giving a reason. The cancellation period will expire 14 days from the day on which you acquire, or a third party (other than the carrier) as indicated by you acquires, physical possession of the goods.

To exercise the right to cancel, you must inform us (RCD Retail Ltd, Via email, in writing or by telephone. Full contact details can be found on the contact us section of our website) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use our cancellation form here but it is not obligatory. If you use this option, we will communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (e.g. by email) without delay.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired. Upon receipt of your cancellation request we shall in all cases provide a returns number which must be included in your return and the address of where to return your goods.

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (excluding supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and no later than – (a) 14 says after the day we receive back from you any goods supplied, or (b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or (c) If there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods whichever is the earliest

You, the customer shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You are also liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature characteristics and functioning of the goods. The buyer will be fully responsible for the full cost of returning the item
